Terms of Service for Fueling Champions, Inc.

Welcome to Fueling Champions!  The following terms and conditions of use and end user license agreement (the “ Terms ”) constitute an agreement between you, or if you are under the age of majority in your local jurisdiction, your parent or legal guardian (collectively, “ user ”, “ you ” or “ your ”) and Fueling Champions, Inc. and its affiliates and subsidiaries (collectively, “ our ”, “ us ” or “ we ”). These Terms govern your use of and access to the App, Site, Services and/or Content (each as specified below) and are a legally binding agreement between you and us.

NOTICE OF MANDATORY ARBITRATION PROVISION

This Agreement contains provisions that govern how claims you and Fueling Champions, Inc. have against each other are resolved, including an agreement to arbitrate, which will, with limited exception, require you to submit claims to binding and final arbitration (see Section 14). By using the Fueling Champions app or website, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

1. Changes to this Agreement

We reserve the right to change these Terms at any time. Any changes will be effective immediately upon posting, and your continued use of the Service constitutes your acceptance of such changes. If you do not agree to the revised terms, please discontinue use of the Service.

2. Eligibility, Accounts, and Consent for Minors

You must be at least 18 years old to use the Service. Individuals aged 13 to 17 may use the Service only with verifiable parental or legal guardian consent. By registering, you confirm that you meet the minimum age requirement or have appropriate parental consent. Parents or legal guardians of minors agree to supervise the minor’s use and are fully responsible for their activity on the Service.

3. Use of the Service

You agree to use the Service only for lawful purposes. You are responsible for maintaining the confidentiality of your account credentials and all activities conducted through your account.

4. Acceptable Use Policy

You may not misuse the Service, including but not limited to: reverse engineering, unauthorized access, or interference with its operation. Any violations may result in termination of access.

5. Intellectual Property / Trademarks

All content on the Service is owned by Fueling Champions, Inc. or its licensors. You are granted a limited, non-exclusive, non-transferable license to access the Service for personal, non-commercial use only. All rights not explicitly granted are reserved.

Trademarks, Logos and Fueling Champions’s Branding
The trademarks, logos, signs, symbols, images and brands (“ Marks ”) displayed on the Site are the property of Fueling Champions, Inc. You are prohibited from using any Marks for any purpose including, but not limited to, use as metatags on other pages or sites on the Internet without the written permission of Fueling Champions or such third party which may own the Marks, which permission may be withheld in the sole discretion of the owner of the relevant Marks. All Content available on or through the Site and/or Services is protected by copyright and/or other intellectual property laws. You are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content for commercial and/or public purposes.

6. User Content

General Content:  Any information, advice, or materials provided through the Services, including but not limited to nutritional data, are for informational purposes only. You are solely responsible for evaluating their accuracy, completeness, and applicability to your needs.

Potential Risks – The use of online services and digital content carries inherent risks, including but not limited to data inaccuracies, service interruptions, and reliance on user-generated content. Users assume all risks associated with their use of the Services and any third-party interactions.


You retain ownership of content you submit, but grant us a non-exclusive, royalty-free license to use, host, and display it for operating and improving the Service.

7. Health & Medical Disclaimers

Fueling Champions provides informational educational nutrition and performance content only. We/The Service, App and or Site do not provide medical, healthcare or wellness advice or treatment. Always consult a licensed healthcare provider before making changes to your or your minor child’s nutrition, exercise, or health regimen.

8. Communication: SMS, NOTIFICATIONS and EMAILS

By creating an account, you consent to receive Notifications, Emails and SMS messages regarding your account, education or Service updates:

  • Message Frequency: Periodic alerts as needed

  • Carrier Rates: Standard text messaging fees may apply

  • Opt-Out of select Notifications in the Profile Section of the App

  • Opt-Out: Reply STOP to any SMS or email us at support@fuelingchampions.co

9. Privacy Policy

Your use of the Service is subject to our Privacy Policy, which governs how we collect and use your data.

10. Term & Termination

This Agreement remains effective until terminated. We may suspend or terminate your access at any time, for any reason, including violation of these Terms.

11. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee that it will be error-free, uninterrupted, or secure.

12. Limitation of Liability

To the maximum extent allowed by law, we are not liable for any indirect or consequential damages. Our total liability will not exceed $10.

13. Indemnification

You agree to indemnify Fueling Champions, Inc. against any claims arising from your use of the Service or violation of these Terms.

14. Dispute Resolution & Arbitration

Disputes will be resolved through binding arbitration in Dallas, Texas. You waive your right to jury trials and class actions. You may opt out by contacting legal@fuelingchampions.co within 30 days of first use.

15. Governing Law and Jurisdiction

These Terms are governed by Texas law. Any disputes not subject to arbitration must be brought in Dallas County, Texas.

16. Payment Terms, Subscriptions and Codes

If you choose to subscribe to any of our Services, these are the payment and billing terms that apply. Paid services and billing will auto-renew unless you cancel. You may cancel at any time.  All payments/subscriptions are non-refundable after purchase.

a) Termination and Cancellation of Services
If you do not pay the fees or charges due for your use of the Services, we may make reasonable efforts to notify you and resolve the issue; however, we reserve the right to disable or terminate your access to the Services with or without notice to you.

You may cancel your subscription to the Services at any time through your Account settings.  The cancellation of the Service will go into effect at the end of your current billing cycle, and you will have the same level of access to the Service through the remainder of such billing cycle. For example, if you are billed on a monthly basis and cancel during a given month, you will be charged for the entirety of that month and maintain access to the Service through the end of that month.

b) Fee Changes
To the maximum extent permitted by applicable laws, we may change the fee we charge for Service at any time. We will give you reasonable notice of any such pricing changes by posting the new prices on or through the applicable Service and/or by sending you an email notification. If you do not wish to pay the new fee, you can cancel the applicable Service prior to the change going into effect.

c) Gift, Discount or Team Codes
If you have received a gift, discount or team code (a “ Code ”) to a Service, the following terms and conditions apply in addition to the terms and conditions of the specific Code.  To redeem a Team Code, after download, enter applicable Team code at subscription selection in Team Code area. .To redeem a gift or discount Code, use the check out via website button after download and enter the applicable Code iDiscount Code area on website shopping cart page. Codes not applicable in App Store check out systems. All Codes can only be applied to Accounts that are not already subscribing to Services.  Codes cannot be exchanged, refunded or redeemed for cash or payment of Accounts.  You are responsible to use a Code before it expires and expired Codes cannot be refunded or extended.  You are also responsible for cancelling or terminating the Service before the end of the free or a discounted period if you do not want to continue with the Service at the regular price.  Fueling Champions may cancel Codes at any time without any liability or responsibility to compensate the Code holder whatsoever.

Fueling Champions reserves the right, but is not obligated, to review its no refund policy upon request and on a case by case basis.

17. Miscellaneous

If any provision is held unenforceable, the rest remain in effect. You may not assign your rights without our written consent.
